NextDrive Rental Terms & Conditions

These Terms & Conditions apply to daily and weekly vehicle rentals with NEXTDRIVE LLC, doing business as NextDrive. By booking, paying, signing electronically, checking out through Wheelbase, accepting terms online, or taking possession of a vehicle, you agree to these Terms, the reservation details, any signed rental agreement, applicable platform terms, and all applicable laws.
These Terms are intended for daily and weekly rentals only. Rent-to-own is handled separately by NextDrive and requires separate approval, separate documents, and a separate rent-to-own agreement.

2. Rental Only — No Ownership Rights
Daily and weekly rentals are temporary vehicle rentals only. A daily or weekly rental does not create a sale, rent-to-own agreement, lease-to-own agreement, financing agreement, purchase option, ownership interest, title interest, lien interest, equity interest, or credit sale.
Rent-to-own is separate and must be approved directly by NextDrive.
3. Eligibility
Renters must meet all NextDrive, Wheelbase, Outdoorsy, Roamly, and applicable platform eligibility requirements.
At minimum, renters must provide:
- Valid driver license
- Accurate renter information
- Valid payment method
- Proof of active liability insurance when required
- Required protection selection when applicable
- Any documents required by NextDrive or the booking platform
NextDrive may refuse, cancel, or terminate a booking if a renter provides false, expired, incomplete, or unverifiable information.
4. Platform Terms
Bookings may be processed through Wheelbase, Outdoorsy, Roamly, or another connected platform. Platform terms, payment rules, verification rules, cancellation rules, protection rules, insurance rules, and claim procedures may also apply.
If these Terms conflict with mandatory Wheelbase, Outdoorsy, Roamly, or platform terms, the platform terms control only to the extent required.
5. Insurance and Financial Responsibility
Renters must maintain active auto liability insurance or other legally acceptable financial responsibility for the entire rental period.
Roamly Rental Shield, Rental Shield, damage protection, or any similar product is not liability insurance unless the written protection terms specifically say otherwise. Roamly Rental Shield is understood to cover physical damage to the rented vehicle only, subject to eligibility, limits, exclusions, and claim rules. It does not cover third-party liability, injuries to others, damage to other vehicles, or damage to other property.
NextDrive does not promise that any personal insurance, credit card benefit, protection product, damage waiver, or platform coverage will cover a claim. Renters remain responsible for all damage, loss, deductibles, excluded losses, uncovered losses, claim denials, third-party claims, and amounts not actually paid by insurance or a protection provider.
6. Payment Authorization
By booking or renting, renter authorizes NextDrive and/or the booking/payment platform to charge the payment method on file for rental charges, deposits, protection products, taxes, surcharges, platform fees, extensions, late fees, cleaning fees, smoking/odor fees, fuel charges, mileage overage, tolls, tickets, towing, impound, storage, recovery, damage, loss of use, administrative fees, deductibles, claim costs, and any other amount owed.
Some charges may be discovered or billed after the rental ends, including tolls, tickets, camera violations, damage, cleaning, smoking/odor, impound, towing, and claim charges.
If a payment method is declined, the renter remains responsible for the unpaid amount.
7. Vehicle Use
Vehicles must be operated lawfully, safely, and only by approved drivers.
Prohibited uses include:
- Unauthorized drivers
- Driving without a valid license
- Driving under the influence of alcohol, marijuana, drugs, or impairing medication
- Illegal activity
- Racing, drifting, reckless driving, burnouts, stunts, or off-road use
- Towing, pushing, pulling, or hauling unless approved in writing
- Rideshare, delivery, taxi, courier, DoorDash, Uber, Lyft, Instacart, Amazon Flex, or similar work unless approved in writing and properly insured
- Travel outside the approved area or outside the United States without written approval
- Smoking, vaping, marijuana use, or allowing smoke/vape odor in or near the vehicle
- Pets unless approved in writing
- Tampering with GPS, tracking, telematics, immobilizer, license plate, registration, equipment, or vehicle systems
- Subrenting, lending, selling, hiding, abandoning, pledging, or transferring the vehicle
Violation of these rules may void protection coverage and make the renter responsible for all resulting losses.
8. No Smoking / No Vaping
Smoking, vaping, marijuana use, tobacco use, cigar use, hookah use, and any similar smoke or vapor activity are prohibited inside or near the vehicle.
A violation may include smoke odor, marijuana odor, vape odor, ashes, residue, burns, cigarette/cigar materials, or other evidence consistent with smoking or vaping.
Renters may be charged for smoking/odor violations, professional cleaning, ozone treatment, detailing, deodorizing, interior repair/replacement, and loss of use while the vehicle is unavailable.
9. Pickup and Return Condition
Renter must inspect the vehicle at pickup and return it in the same condition received, except ordinary wear from normal permitted use.
Renter may be required to complete pickup and return photos, video, odometer photos, fuel photos, and condition documentation through Wheelbase, Outdoorsy, NextDrive, or another approved process.
If renter fails to report pre-existing damage before driving away, renter may be responsible for damage found later unless clear evidence shows the damage was pre-existing.
10. Mileage, Fuel, Tolls, Tickets, and Fees
Renter is responsible for mileage overage, missing fuel, cleaning, smoke/odor, late return, tickets, tolls, parking violations, camera violations, speeding tickets, red light tickets, towing, impound, storage, lost keys, damaged keys, missing equipment, tire damage, wheel damage, glass damage, and related administrative or processing fees.
Charges may be billed after the rental ends.
11. Damage, Theft, Loss, and Claims
Renter is responsible for damage, theft, loss, loss of use, diminished value, towing, storage, impound, recovery, claim expenses, administrative expenses, appraisal or estimate fees, diagnostic fees, deductibles, keys, plates, registration, tires, wheels, glass, undercarriage, interior damage, smoke/odor damage, pet damage, biohazard, flood damage, and damage caused by negligent, reckless, prohibited, or unauthorized use.
Renter must not abandon the vehicle or leave it unsecured.
Renter must immediately report accidents, theft, vandalism, damage, towing, impound, police contact, warning lights, or unsafe mechanical issues to NextDrive and the booking platform when required.
12. Late Return, Extension, and Failure to Return
Vehicles must be returned by the scheduled return date and time unless NextDrive approves an extension in writing before the return deadline.
Payment alone does not guarantee an extension.
If renter is late, renter may be charged additional rental charges, late fees, loss of use, recovery costs, and related expenses.
If renter fails to return the vehicle, refuses to return it, hides it, abandons it, disables communication, disables tracking, converts it, attempts to sell or transfer it, or keeps it beyond the approved period without authorization, NextDrive may treat the vehicle as overdue and may pursue all lawful remedies.
NextDrive may locate, remotely disable, tow, or recover the vehicle where allowed by law and without breach of the peace.
13. GPS, Tracking, and Telematics
Vehicles may be equipped with GPS, telematics, tracking, immobilization, diagnostic, or recovery technology.
Renter consents to the use of this technology for vehicle location, mileage, maintenance, safety, insurance, theft prevention, recovery, claim investigation, and contract enforcement.
Tampering with, removing, shielding, jamming, disabling, or interfering with GPS, tracking, telematics, plates, or vehicle systems is prohibited.
14. Personal Property
NextDrive is not responsible for personal property left in, on, or around the vehicle. Renters should remove all belongings before returning the vehicle.
15. Cancellation Policy
Cancellation terms may depend on whether the booking is made through Wheelbase, Outdoorsy, or another platform.
For Outdoorsy-originated bookings, Outdoorsy’s selected cancellation policy and platform rules may apply.
For direct Wheelbase bookings, NextDrive may use the cancellation policy shown during checkout or in the reservation. Protection products, platform fees, taxes, add-ons, and service fees may be refunded or withheld according to Wheelbase, Outdoorsy, Roamly, payment processor, or third-party terms.
16. Electronic Signature and Online Acceptance
Renter agrees that this transaction may be completed electronically. Electronic signatures, typed names, checkbox acceptance, online acceptance, booking confirmation, payment submission, IP address records, timestamps, and e-signature audit records may be used as proof of agreement.
By checking the acceptance box, completing checkout, signing electronically, paying, or taking possession of the vehicle, renter agrees to these Terms.
17. Governing Law and Venue
These Terms are governed by Tennessee law unless controlling platform terms require a different dispute process for platform-related matters.
Unless another venue or process is required by law or platform terms, any court action between renter and NextDrive related to a rental shall be filed in the appropriate court located in Shelby County, Tennessee.
