NextDrive Terms & Conditions
Last updated: October 27, 2026 (version 2026-10-27.v24r)
1. Paid booking cancellation before handover (not active)
Paid booking cancellation before handover (being prepared, not active): NextDrive reviews actual no-handover evidence before recording a cancellation. An owner's preparation or inspection alone is not your receipt of the vehicle. A canceled unused Lease or Gig-Work booking is not a vehicle return, creates no customer debt in this closeout and starts no new 45-day deposit clock. Eligible original cash is refunded only to its original payment method; pending, unknown, failed or disputed outcomes require review and are not verified refunds. Provider confirmation does not prove bank arrival. Transferred deposit credit is non-cash: it is restored once to its original deposit account only after all required cash refunds are verified, retaining that account's actual-return deadline and original tax basis. My NextDrive shows your own cancellation status even when the booking is closed, without requiring texts. Rent-to-Own and earlier signed agreements keep their exact rights; this draft does not grant cancellation rights under them or override applicable law.
2. Fixed-term Lease renewals (not active)
Fixed-term Lease renewals (being prepared, not active): a future Week-by-Week Lease or Gig-Work Lease covers one fixed term that ends 28 Central calendar days after the certified pickup, at the same Central clock time. It never renews automatically, and a payment alone never continues it. In your last 7 days you can ask for another term in My NextDrive; text messages are not needed. A renewal offer is a proposal, not a contract or a payment: it lists every weekly invoice and due date for that term, and it starts only after your current vehicle is actually returned and inspected, you sign a new agreement, insurance is verified and a new pickup handover is recorded. Nothing is billed before that pickup or after the term ends, except holdover your agreement expressly allows. A one-time $25 per week loyalty reduction, prorated and never more than $100 for the term, may apply only to your second activated term when NextDrive approves it; later terms use the regular weekly rate. Renewal paperwork alone does not decide how any charge is taxed. Earlier signed agreements keep their own terms. Rent-to-Own is not included.
3. Prospective itemized Lease and Gig-Work pricing
Prospective Lease and Gig-Work pricing (not active): your exact quote and matching agreement show agreed rent, separately identified insurance or related charges, each applicable added or included tax, the deposit at its full amount, any genuine non-cash deposit credit and the exact cash due before you accept or pay. Included tax is absorbed within the agreed price; it is not charged again. Existing paper, digital and manual included-price agreements keep their original gross total; an owner profile assignment alone cannot raise it. A changed price requires a new exact quote and your fresh acceptance under matching terms. Unknown tax allocation is shown as unknown, not zero, and does not stop legitimate unchanged legacy payments. Unverified local rates, applicability or exemption evidence keep new pricing on review hold. A refundable deposit or deposit transfer credit is not taxable rent. Refunds use the original payment's component and frozen tax record, not today's profile: a deposit-only refund does not reverse rental tax. Proposed deductions, approved deductions, disputed amounts, processing funds and verified refunds stay separate; provider confirmation is not proof of bank arrival. This does not change signed terms, invent a new GPS tax or imply taxes have been filed or remitted. My NextDrive works without text messages.
4. Future excess-speed charges (not active)
Unreleased v2.4 Week-by-Week Lease and Gig-Work Lease drafts include a separately accepted excess-speed schedule: >=1 and <10 mph over: $0.35/min; >=10 and <15: $0.65/min; >=15 and <25: $1.25/min; >=25 and <50: $2.50/min; >=50 mph over: $5.50/min. Actual mph tiers: >=65 and <75: $6.50/min; >=75 and <85: $8.50/min; >=85 and <95: $12.50/min; >=95: $24.50/min. Every monetary tier requires verified speeding at least 1 mph above the verified posted limit. Lawful 65 in 65, 75 in 75 or 95 in 95 is zero. Apply only the highest applicable rate, never stack tiers. Supported fractional seconds are prorated and each incident is rounded once; no excess-mph multiplier or mile fee. 60 in 55 for 3 verified minutes = $1.05, with retained draft caps of $25 per incident and $50 per Central calendar day (not newly authorized or legally cleared), including charges already posted that day. Each incident is assessed once. Only supported measurements are billable; you can see the records and ask for review within 30 days without waiving later legal rights, and unsupported charges are reversed. A government ticket is separate and is not this charge. It does not apply to Rent-to-Own or to any current signed agreement unless you accept a new addendum. Speeds of 95 mph or more may create a request to prevent a later restart only; it never stops a running engine. Charges and starter controls are not active.
5. Future safety appendix and liability review
Future v2.4 Lease, Rent-to-Own and distinct Gig-Work drafts are unreleased and do not replace signed terms. Their vehicle-specific checklist begins Not checked; actual driver, coverage, recall and mechanical checks require a human. Missing checks, safety failures and unresolved recalls block readiness; customer pickup acknowledgment is separate and does not waive latent-defect or nonwaivable rights. 49 U.S.C. § 30106 may limit a rental/lease owner's liability based solely on ownership only when its statutory conditions are met. It does not waive direct negligence, negligent entrustment or maintenance, criminal wrongdoing, financial responsibility or insurance duties. No immunity or inability to sue is promised. Rent-to-Own is an installment sale and security agreement: applicability depends on the actual transaction, does not reclassify it and requires actual Tennessee counsel review. Original due/default clocks and 45-day deposit accounting from actual surrender remain unchanged.
6. Private registration and Lease extensions
Keep the paper vehicle registration in the glovebox. Eligible current customers may view a vehicle-specific private digital copy in My NextDrive when it is on file; returned or closed accounts cannot access later copies. A 28-day Week-by-Week Lease extension may be requested in the final 7 days of an actual evidenced current 28-day term. Approval alone does not extend it. The owner reviews actual original signed or authorized paper terms, rate, schedule and Fee Exhibit; a matching reviewed addendum requires genuine customer and company signatures before activation. Original contracts, copies and unchanged terms remain. Required digital camera/microphone evidence requires separate explicit consent and actual release/retention/device evidence; legally required alternatives remain. Rent-to-Own is not eligible; no equity, title transfer or swap is created.
7. About these terms
These terms cover use of rentnextdrive.com and My NextDrive. Your signed program agreement controls your actual obligations. If anything here differs from your signed agreement, the signed agreement controls. These website terms do not change any signed agreement.
8. Requests are not agreements
Browsing, texting, submitting info, uploading documents or requesting a vehicle does not create a lease or Rent-to-Own agreement, does not reserve a vehicle and does not guarantee approval, pickup or availability. Pickup requires explicit approval from NextDrive, any required payment and deposit, active full coverage insurance, a signed agreement and a confirmed appointment. Meeting these requirements does not by itself guarantee a particular vehicle or result.
9. Week-by-Week Lease
No ownership, no payoff, no title transfer and no equity. Every lease requires a refundable lease deposit starting at $200; the vehicle listing shows its actual deposit. Friday: weekly payment + refundable deposit. Monday-Thursday: refundable deposit + prorated pickup-day amount. Saturday/Sunday: final review before an exact quote. Regular weekly payments are due Friday by 5 PM Central unless your agreement says otherwise. Deposit return follows your Lease agreement and its 45-day review from the confirmed return date.
10. Rent-to-Own
A path to ownership under your signed agreement. Required down payment only; first regular payment the next scheduled Friday. You can request an itemized early payoff quote under the agreement. NextDrive does not offer Rent-to-Own swaps, trade-ins or vehicle exchanges.
11. Insurance
Insurance is optional when applying or viewing the parked vehicle. After approval, submit coverage for the actual vehicle and required driver/program details. NextDrive must verify required coverage before any driving, including test drives, and before key release. Coverage or a test drive is not approval, a reservation or payment. Full coverage insurance is required before pickup and must stay active the entire agreement. Liability-only coverage does not meet this requirement.
12. Mileage
Unlimited In-City Miles for normal local Memphis-area use. Week-by-Week Lease standard local-use limit: 75 miles from your actual pickup location, as shown in your signed agreement. Out-of-area trips need prior written approval. Rent-to-Own follows its own signed terms. Existing signed agreements and documented approved exceptions keep their own exact terms.
13. Readiness and condition
Readiness or notice times are for review, preparation and scheduling, not a repair guarantee. Disclosed conditions are shown on the listing; NextDrive is not promising to repair a disclosed condition before pickup.
14. Payments
No payment is taken with an application. After approval, eligible Lease accounts pay confirmed itemized amounts through secure Stripe checkout in My NextDrive; the pickup payment opens only after NextDrive confirms your arrival and your agreement is signed. Rent-to-Own online payment is enabled separately and is not available for every account. Stripe processes the payment, eligible methods appear at checkout (buy-now-pay-later options are not offered), and a payment counts only after Stripe confirms it; processing is not paid. Nothing is charged automatically: optional autopay, automatic GPS fee charges and recovery charges are currently off. If optional autopay is offered later, it needs your separate authorization for regular installments, and you can turn it off for future payments at any time; turning it off does not cancel what you owe. Apple Pay or Cash App Pay shown at secure checkout are Stripe wallet payments and post automatically once Stripe confirms them. NextDrive no longer accepts direct person-to-person Cash App or Apple Cash transfers, and the old "I've sent my payment" reports are retired; earlier reports stay in your history. AI, payment notifications and statement matching cannot create current payment receipts. Earlier signed accounts may enter through an owner-reviewed original scan and authoritative history import. Failed, refunded or disputed payments are shown as exceptions for review, never as paid.
15. My NextDrive
Access is by invitation for approved customers. Keep your sign-in private. Extension or schedule changes in the portal are requests, not approvals. Messages alone do not change your payment schedule. A payment arrangement offer shows the exact affected installment, amount, Central due time, expiry and terms. Only your acceptance of a current owner offer saves that arrangement; no payment or fee is posted. You may counter or decline. Request notifications may remain unsent drafts and are not delivery confirmation.
16. Electronic signing
Approved agreements are signed electronically in My NextDrive. Before signing you see the exact agreement text and version, a completed summary of the actual dates and amounts, and any fee exhibit for your contract. Key clauses require your individual initials. Signing records your explicit consent to electronic records and signatures under the federal ESIGN Act and Tennessee's Uniform Electronic Transactions Act. Online signing opens 30 minutes before your confirmed pickup. New recorded signing is not active yet. When released, a camera and microphone recording while you initial and sign is required for online signing, with its own consent; it also captures the app's own rendered signing view (the agreement page shown and your initials and typed name), never your device screen or other apps; if you cannot record, NextDrive arranges another way to sign, such as in person. Legally required alternatives remain available. Existing signed versions and their copy and recording access rights remain unchanged. An owner test does not activate signing or establish support on other devices. One-time device location and a signer-provided signing address are separate unchecked choices and are never required to sign. Existing v2.2 keeps its copy-after-signing promise. A separately reviewed new v2.3 locks the completed signed copy and recording until matching verified successful pickup payment; full pre-sign terms and retainable disclosures remain available to save or print. Early signing never certifies a future inspection; actual inspection and handover are acknowledged at pickup. NextDrive's own signature is a separate step and is labeled pending until done. Paper-signed agreements may be kept as private scans; they are separate from online signing.
17. GPS speed policy (not active)
If a future v2.4 Week-by-Week Lease or Gig-Work Lease is released and you sign it, My NextDrive shows each calculation separately from actual posted fees: a calculated-only amount is not owed and is never taken from a deposit. Each posted fee is itemized in Central Time with its supported segments, speed, verified posted limit, seconds and per-minute rate, the incident and Central-day caps, earlier charges that day, credits, reversals, any deposit applied or restored, verified payments, payments still being checked (never counted as paid) and what remains. You can ask about any posted fee in Requests; an open review pauses new collection, deposit use and GPS texts for that fee. Optional GPS fee texts and an optional saved card for posted GPS fees are separate choices from rent autopay and reminders; both are off unless you choose them, can be turned off any time, and STOP stops all NextDrive texts. Saying no never affects your rental and never waives a legitimate fee. A 95 mph or higher event can only lead to a next-start request, never stopping a running engine, with safe-park and emergency assistance; payment alone never automatically restores a start. A GPS fee never extends the Lease 45-day deposit accounting from actual surrender. Rent-to-Own never has these fees. None of this is active today; earlier signed agreements and consents keep their own versions, and nonwaivable legal rights and conditional Graves Amendment limits are unchanged.
18. SMS Terms
One-time sign-in codes and optional account reminders are separate. See SMS Terms for details. Proposed combined customer texts (being prepared; replacement carrier approval and combined routing are not active): after replacement carrier approval and a guarded switch, NextDrive proposes using the existing (901) 244-4352 customer sender for optional application/account updates, payment reminders and Lease renewal/return, deposit and refund status. Current reminder and customer-care approvals stay within their current scope until then; staff texts remain separate. Each purpose keeps its own optional, initially unchecked consent and current-version requirements; no new enrollment or marketing is created. Existing consent wording, versions, timestamps, phone bindings and opt-out history are preserved. STOP still stops customer texts; unblocking never enrolls you. Reminders remain limited to 1 per rolling 24 hours including confirmation, within the shared maximum of 3 automated texts per rolling 24 hours, 9 AM–8 PM Central. Message and data rates may apply. My NextDrive works without texts. Message and data rates may apply. Reply STOP to stop or HELP for help. You can also opt out in My NextDrive Account. Carriers are not liable for delayed or undelivered messages. Support: text 901-613-0332 or email support@rentnextdrive.com.
19. Refunds and cancellations
See the Refund & Cancellation Policy. Your signed agreement and applicable law control. Earned payments: NextDrive does not give voluntary refunds of rent or other payments that your signed agreement makes non-refundable once earned — for example for a change of mind, nonuse, early return or customer default. Your exact signed agreement and any law that cannot be waived still control. This is separate from amounts that are still returned or corrected: an eligible refundable Lease deposit balance, duplicate, unauthorized or over-payments, any remedy the law requires for a booking that was not delivered, and any Rent-to-Own surplus the law requires. You may contest a charge, including with your card issuer. Contested charges get a human review, and a dispute by itself never triggers repossession, collections or a penalty; default remedies apply only as your agreement and the law allow. Lease deposit return: the owner individually approves each deposit return; nothing is paid out automatically. Accounting is due within 45 days after the exact recorded time of the vehicle's actual return (even if NextDrive verifies it later), or sooner if the law requires. A return report or text by itself does not start that period, and a later notice, dispute, inspection or transfer never restarts or extends it. Only owner-reviewed, itemized deductions your signed Lease supports reduce the deposit; proposed and disputed items are shown separately, and a deposit is never kept as a whole just because one charge exists or when it is legally owed back. A later toll or ticket shows the date it happened from its notice, which must fall within your recorded possession; a fuel, cleaning or smoking finding may instead show the actual inspection or service date after return; each also shows the date it was added in My NextDrive. Inspections, uploads, GPS or command results and new tickets never extend the 45 days. Rent-to-Own down payments and payments are not refundable Lease deposits. Final balance: when itemized final statements are used, a balance on an owner-approved itemized final statement is due 30 calendar days after that statement is actually delivered to you — not from the return date or the 45-day deposit date. After the full due date passes, an unpaid eligible balance moves to NextDrive's internal Collections review. That review is internal: no outside collection agency is engaged, nothing is reported to credit bureaus, no collection fee is added, and an open dispute, bankruptcy, a pending payment or unresolved records keep the balance on hold.
20. After a return or recovery
NextDrive is preparing an itemized final-statement process (draft v2.4 terms, not yet reviewed or active). Today, your signed agreement controls. When used, a final statement lists only charges your executed agreement supports, with dates and evidence, credits your payments and applies a refundable Lease or Gig-Work deposit once. Any amount above the deposit is still owed; any unused deposit is refundable. Regular weekly payments, autopay, payment reminders and late fees stop once the vehicle is actually returned or recovered; unpaid amounts earned before then are reviewed on the statement, and future weeks are never billed. A statement is final only when nothing on it is still under review. A final balance is due 30 calendar days after the statement is actually delivered: when you confirm receipt in My NextDrive, or by certified mail or a signed in-person copy. A sent email or text alone is not delivery. You can dispute any item; a dispute pauses recovery actions until NextDrive resolves it with evidence or delivers a corrected statement. The 45-day Lease deposit accounting from actual surrender is never delayed. Rent-to-Own repossession never automatically makes all remaining payments due. Saved-card charges and recovery texts each need your separate, optional consent and are currently off. Any collection referral goes to one verified firm at a time; collection costs apply only to the extent your signed agreement expressly provides and the law permits, with no automatic percentage surcharge. Whole-account history and all applicable net payments must be reconciled; missing history or unresolved funds prevents a final collectible balance or determined refund. A reduced charge preserves paid cash, with deposit refund and cash overpayment shown separately as pending, not paid. The full 30th Central calendar date remains available. A verified payment to an authorized collector reduces debtor debt before company remittance; commissions are business expenses by default. Candidates remain unapproved; consumer/corporate debt, actual jurisdiction, current firm licensing and engagement require evidence. Collection costs start at zero, and Tennessee pass-through is unresolved and blocked. Accounting overdue requires action, not an indefinite hold. Online payment of a delivered final statement (prepared, currently off): you may voluntarily pay all or part of the current verified balance through Stripe's secure checkout. It is credited only after Stripe confirms it, never because you returned from checkout, and appears once on the statement; a refund or dispute pauses the statement for review. Rent-to-Own final balances, disputed, held or collector-placed accounts cannot be paid this way. Separately, you may choose to give card permission for one statement by agreeing to its exact text; it is never your installment autopay, no extra card hold is placed at pickup, you can turn it off any time, and no automatic attempts are active. Automatic card attempts happen only with your separate card permission for that exact statement (at most 3 attempts, 72+ hours apart, from 9 AM Central the day after the due date until the end of due date + 7 days); they are not turned on today. Optional final-bill texts are a separate choice in My NextDrive with their own wording; you confirm your time zone, can turn them off any time, and they are not active today.
21. Final-bill evidence and refunds
Verified credits preserve the original delivered bill and due date; material charge changes require a delivered correction. A private reference package includes only the selected current itemization, original totals, verified credits and exact agreement/firm/engagement references; it is not a complete submitted referral. Licensing, review expiry, revocation and exact collector identity are checked again at each release. Packets use opaque evidence IDs/hashes, never private paths, document links or confidential evidence text; material entity or engagement-term changes require new case-specific evidence. Refunds remain separate: unused Lease deposit, cash overpayment and actual collateral surplus. A supported Stripe refund binds its exact original captured receipt component and goes only to the original method; cumulative partial refunds and unresolved requests cannot exceed remaining component or captured cash. Pending, action-needed, failed, canceled and unknown are distinct; failed or canceled returned funds are not a completed refund. Stripe confirmation is not proof of bank arrival. Cash, mixed-origin and unprovable allocations require actual original-tender evidence. Rent-to-Own final principal is supported only for an exact digital zero-finance classification with documentary professional recourse, actual disposition, no-double-recovery and signed down-payment findings; missed principal is replaced, never added, and surplus stays separate. Separate condition fees or incurred costs never silently consume a principal surplus; absent exact applicable review, final payable figures remain provisional. Financed, tax, paper and true-rental ambiguity stay on explicit review holds; being final never grants online processing approval.
22. Contact
Text 901-613-0332 or email info@rentnextdrive.com.
23. Contactless returns (prospective)
Contactless returns (being prepared, not active for current agreements): a future Week-by-Week Lease or Gig-Work Lease may include an optional section you can accept or decline when signing. Tapping Complete in My NextDrive only reports your return; your actual return is recorded at the exact time it happened, even if NextDrive verifies it later (in person, or when NextDrive's written return policy checks a fresh GPS reading (vehicle stopped, engine off, inside the private drop zone)). If you accept, NextDrive may ask a reviewed, supported device to block only the next engine start after your actual return. It never shuts off a running engine, is never used to collect money, and can be released at any time, including in an emergency. If you decline, NextDrive completes the return in person or by phone. Rent and fees end at your actual return. Your deposit accounting is due within 45 days after your actual return (or sooner if the law requires); inspection, a dispute or a deposit transfer does not restart that clock. Proposed deductions are shown separately from approved ones and can be disputed. A refund goes back to the original payment method; the payment provider's confirmation is not the same as money arriving at your bank. An optional deposit credit toward a new agreement is non-cash and only with your own consent. Returned, inspected and ready for the next customer are separate steps. Rent-to-Own is not included.
24. Lease return texts (prospective)
Lease return texts (being prepared, not active): a separate, optional service program about your own Week-by-Week Lease or Gig-Work Lease return — your return time, steps and return status — never marketing. It needs its own unchecked opt-in in My NextDrive for your verified phone, is sent only 9 AM–8 PM Central, and shares the limit of 3 automated texts per rolling 24 hours with other NextDrive programs. STOP to any NextDrive number stops all automated texts and can't be undone from the website; HELP comes from the text provider. My NextDrive always works without texts. If NextDrive lists an automated return number in My NextDrive, texting COMPLETE to it from your verified phone confirms you parked in the named drop spot, turned the engine off, left the keys in the named spot and are outside; it only reports your return, like the portal button. That number does not answer chats — the main NextDrive line (901) 613-0332 is for people, not automated returns. For a paid unused Lease or Gig-Work booking, the same optional lease-service consent may cover rental refund status: being prepared, pending verification, verified original-method refund or review required. These notices need a genuinely approved current exact template set and re-check your own current status before dispatch; verification does not prove bank arrival. No return plan is created for a cancellation. A restored deposit-credit notice stays with its original return account and deadline. No new consent or text program is created, and no text is promised.
